Collective agreements for industry organisations

There are a number of conditions that must be met in order for a trade association to be eligible for a collective licence.

Terms and conditions

  • You carry out activities on behalf of or in the interests of members, such as lobbying, collective bargaining, setting up innovation projects, providing economic and/or legal advice, organising information meetings, collective purchasing, etc.;

  • You have no commercial purpose; subsidies, donations and other income benefit the purpose of the trade association;

  • You are registered as an association or foundation in the trade register and the association is actively committed to representing the interests of its members;

  • As a trade association, you are representative of the industry, sector or category of services or products.

In addition to the conditions mentioned above, the following points are assessed when deciding whether or not to grant a collective licence:

  • The administrative costs and credit risk for Sena must remain low after the collective licence has been issued;

  • The collective arrangement must be in the interests of Sena's rights holders;

  • In the context of market coverage and risk management, the number of members, the description of the objective and the target group play a role;

  • The remuneration largely ends up as a member benefit that benefits music users and rights holders: the company where the music is played;

  • The remuneration obtained is not used as a “growth tool”, whereby over time the remuneration mainly benefits the organisation itself rather than the participants;

  • The target group already makes use of any other collective schemes;

  • The extent to which members have a say in the implementation of the policy;

  • The consideration takes into account whether the policy of the trade association reflects on Sena;

The licensee acts as an “ambassador” for Sena. The more actively and positively they communicate about us, the more this justifies a collective agreement. Image improvement and prevention of reputational damage play an important role within the collective arrangement.
